Rangwe MP George Oner appeared in a Nairobi court Monday for a mention of a criminal case in which he is charged with fraud.
The politician will face trial on January 24 2014 although a petition he lodged in protest is still pending at the High Court.
He has accused the DPP of “malicious prosecution.”
In the criminal case, Mr Benson Ritho, a Nairobi businessman, claims that the MP sub-divided and sold 590 plots of prime land in the city’s Embakasi area without the trader’s permission.
The businessman claims he employed the MP as a surveyor but the latter abused his trust and sold the land to third parties including former Embakasi MP Ferdinand Waititu.
Mr Oner was charged at the Milimani law courts two weeks ago with offences arising from the sale of the sub-divided plots.
He also faces a civil suit, still pending determination, at the High Court over the land transactions.
He has denied a charge of making a false document purported to have been issued at KRA for the cancellation of charges on the disputed plots.
